Undercutting & Blabbing

A colleague of mine told me about a real estate agent who wanted the homeowner to “dump” her for an attorney charging $300 less, though the agent was charging that seller a commission of 6%, which is 2% more than the customary rate!

I commiserated, just having had an agent cut me out of a deal. Besides the old axiom about getting what you pay for, there’s something more insidious at work. (Certain) agents want to be privy to things that should only be discussed between attorney and client, and some in my profession willingly breach their ethics by sharing info with their source of business, the agent.

What, you think a breach of confidentiality is no big deal in a real estate deal? I just consulted with a former homeowner who wants to start a lawsuit against an attorney, a real estate agent and a broker who she’s positive shared information with each other and ultimately with the buyer. That breach ended up costing her $9,200 at closing.  Ouch.
