How Could You Know?

I signed up for an e-newsletter, and the moderator sent me a note asking how I was doing.  I tried to sum up my dilemma in a few words to a stranger by replying that this was the wrong thing to ask a real estate attorney nowadays!

Of course, she didn’t know me or my writing style, and so she replied that she hoped I wasn’t offended by her inquiry.  Of course I wasn’t, and I related to her the following story about how an innocently friendly gesture can unknowingly backfire:

Years ago, I represented the sellers at a closing where the mortgage broker gave the borrower/buyer a bottle of champagne once the transaction concluded.  The buyer stood abruptly, grabbed his papers and left the room without any further comment. The red-faced and confused mortgage broker just stood there with the foil wrapped bottle in his hands, so the buyer's attorney explained that he'd met his client in an AA meeting.  The broker stammered and apologized, but how was he to know?


On the way out I told the broker that maybe he should consider giving a subscription to a home magazine instead of alcohol at his next closing (but since he worked for American Home Mortgage, who closed shortly afterwards, the suggestion may have proved worthless).
