Vacation Post #5

OK, the prologue is totally wrong for an August 2010 entry.  But this is one of the blog entries that readers frequently comment on when they talk to me! Happy birthday, Brian--and everyone, have a great weekend!

There's Got To Be A Morning After (Or, Never Party With Your Buyers Before Closing)

This morning, after the greatest upset in Super Bowl History since 1969, I recall a story told to me many years ago by an attorney named Ivan.  He was a large, pleasant man, fond of telling stories that I wasn't always sure were embellishment-free.  So keep that in mind as I relate the story which follows.

Ivan represented Sellers whose closing was scheduled for the Wednesday after the Super Bowl.  In a lovely gesture the Sellers invited the Buyers to join them in the last Super Bowl party they would host at the home they were selling.  The party got loud, the drinks were flowing, and Mr. Buyer joined in drinking games as Ms. Buyer grew increasingly agitated.  Near the end of the game, Mr. Buyer deposited the contents of his stomach on the newly finished hardwood floors and passed out before he realized Ms. Buyer had taken the car and left him behind.  

How far behind did she leave him?  Very, very far behind.  Seems Mr. Buyer had been a recovering alcoholic, a fact unknown to the Sellers but well known to his wife.  Her parents had cautioned her not to marry him, and when he got rip-roaring drunk, she panicked and drove all night back to Virginia and her parent's home.

I don't know if they reconciled, but I do know the Buyers had only put $5,000.00 down on the house as a downpayment.  And with Mr. Buyer on a bender and Ms. Buyer in Virginia, neither showed up at the closing on Wednesday and defaulted, leaving Sellers with an empty, unsold house which reeked of vomit and had, I suspect, a rather nasty stain on the floor that needed refinishing again.
