Give 'em the old razzle dazzle and they'll never catch wise

I touched a nerve with yesterday's blog entry, based not only on the posted comments, but in the dozens of private e-mails and a few phone calls I got from outraged clients, colleagues and friends.  Most wanted Mr. G's name so they could report him, some wanted to tell me a story they heard, and a few just wanted to pay me a compliment (thanks so much).  The themes of the day were:  How can someone act like him and get away with it?  Why did I not report him and why did his client do nothing?

Many correspondents seem to believe the Bar Association is an enforcement agency, but it is not.  It is a voluntary organization made up of dues-paying lawyers.  One attorney telling the Bar about another attorney's bad behavior would be an exercise in futility, in my limited experience.  Besides, I suffered no actual harm, and spotted no actual malpractice, just the potential for some harmful consequences to Mr. G's client.

Any allegation of harm and/or over-charging would have had to come from Mr. G's client, who seemed passive about his attorney's departure.  Had his attorney somehow intimidated him into believing this was customary, bamboozled him into thinking he was still protected while he was actually vulnerable, or otherwise deluded this paying customer into being grateful for whatever bread-crumbs of representation his attorney deigned to give him?

Those questions led me to wonder whether most persons hiring attorneys know what their rights are in the relationship.  There are clearly established rights in most states, and I have a "Statement of Client's Rights" printed and displayed close to the door to my office.

Here’s #1: You are entitled to be treated with courtesy and consideration at all times by your lawyer and the other lawyers and personnel in your lawyer's office.
