Talk First, Sign Second

One of my pet peeves in real estate is my fellow counsel failing to explain documents to his or her client at closing, Each time I see it happen, I cringe. And I always wonder why clients don’t question more.  Trust in a professional is fine, but your signature is your most important asset at times— don’t affix it without total comprehension!

Only once did I witness someone balk at being short-changed by an attorney.  At this closing, the buyers paled when they took a look at the pile of mortgage papers to be signed. Their attorney told them not to worry, and just start signing.

He assured them that all the papers were “standard,” and besides, he knew everything in them. “Really?” asked a buyer. You got here the same time as we did, and haven’t read one thing. Let’s go through all the papers together!”
